These Terms of Service ("Terms") govern your access to and use of Callboard, a platform for community theatre companies to manage their productions, members, scripts, schedules, recordings, and auditions. Callboard is operated from New Zealand ("we", "us", "our").
By creating an account, joining a production, or otherwise using Callboard, you agree to these Terms. If you do not agree, please do not use the service.
You must be at least 13 years old to create a Callboard account. If you are under 18, you may only use Callboard with the involvement of a parent, guardian, or responsible adult within your theatre company.
You are responsible for the accuracy of the information on your account, for keeping your password confidential, and for all activity that occurs under your account. Tell us promptly at hello@callboard.nz if you believe your account has been accessed without your permission.
You may not share an account with another person, create an account on someone else's behalf without their consent, or use Callboard if we have previously terminated your access.
Content in Callboard is organised into productions. The person who creates a production is its owner, and may appoint admins and grant roles and capabilities to other members.
You retain all ownership of the content you upload to or create within Callboard — posts, announcements, notes, schedules, scripts and scores, audio recordings, video clips, images, budgets, and audition information ("Your Content").
You grant us a limited, non-exclusive, worldwide licence to host, store, reproduce, transmit, and display Your Content solely for the purpose of operating and providing the service to you and the members of your productions. We do not use Your Content for advertising, and we do not sell it.
You are responsible for Your Content, and you confirm that you have the rights necessary to upload and share it. In particular:
We do not routinely review Your Content, but we may remove content or suspend access if we reasonably believe it breaches these Terms or the law, or if we receive a valid rights-holder complaint.
When using Callboard, you must not:
Callboard offers a free tier and paid subscription plans (Starter, Pro, and Company), along with one-off production activation purchases. Plan features and prices are shown on our pricing page and may change from time to time; we will give you notice before a price change affects an existing subscription.
If a payment fails or a subscription lapses, features above your current plan level become unavailable. Your data is not deleted for this reason alone.
Callboard — including the software, design, branding, and documentation — is owned by us and protected by intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the service in accordance with your plan. They do not grant you any ownership of, or right to copy, modify, reverse-engineer, or create derivative works from, the service.
If you send us feedback or suggestions, we may use them to improve Callboard without obligation or compensation to you.
Callboard relies on third-party providers — including Supabase, Stripe, Cloudflare, Apple, and Google — to operate. Your use of the service is also subject to their terms where relevant, and we are not responsible for their acts or omissions. See our Privacy Policy for how information is shared with these providers.
We aim to keep Callboard available and reliable, but we do not guarantee uninterrupted access. The service may be unavailable during maintenance, updates, or events outside our control.
We may add, change, or remove features over time. If we discontinue a material feature or the service as a whole, we will give reasonable notice and, where practicable, a way to export your data.
You may stop using Callboard at any time, and you may request deletion of your account by contacting us. Deleting your account does not automatically delete content shared into productions you belong to, and does not delete productions you own — close those separately if you want their content removed.
We may suspend or terminate your access if you materially breach these Terms, if your use puts the service or other users at risk, or if we are required to do so by law. Where the circumstances allow, we will give you notice and an opportunity to fix the problem first.
Sections that by their nature should survive termination — including content licences already granted, intellectual property, disclaimers, liability limits, and governing law — continue to apply after your account ends.
Callboard is provided "as is" and "as available". To the extent permitted by law, we make no warranties of any kind, whether express or implied, including as to merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the service will be error-free, that it will meet your requirements, or that content will always be available or free from loss. You are responsible for keeping your own copies of anything important — treat Callboard as a working tool, not your only backup.
Nothing in these Terms limits rights you have under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded. Where you use Callboard for business purposes, you agree that those Acts do not apply to the extent the law allows them to be contracted out of.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, or for loss of profits, revenue, goodwill, or data, arising out of or in connection with your use of Callboard.
Our total aggregate liability for all claims relating to the service in any 12-month period is limited to the greater of NZ$100 or the total amount you paid us for the service in that period.
You agree to indemnify us against claims, losses, and reasonable costs arising from Your Content, from your breach of these Terms, or from your infringement of anyone else's rights — including rights-holder claims relating to scripts, scores, or recordings you upload.
We may update these Terms from time to time. We will notify you of significant changes by email or via an in-app notice. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of Callboard after a change constitutes acceptance of the updated Terms.
These Terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts.
